By downloading, installing, or using Ghost (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Ghost is an AI-powered assistant that helps you work across applications on your computer. The Service includes:

  • AI assistance for tasks across your email, documents, messages, and other applications
  • Screen understanding capabilities to provide contextual help
  • Personalization features that learn your preferences and communication style
  • Integration with third-party services and applications

Features and functionality may change as we continue to develop and improve the Service.

3. Account Registration

To use Ghost, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent.

You agree not to use Ghost to:

  • Infringe on the intellectual property rights of others
  • Generate, store, or transmit harmful, threatening, or harassing content

  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service for competitive analysis or to build a competing product

We reserve the right to suspend or terminate accounts that violate these terms.

5. Intellectual Property

Our Property: Ghost, including its software, design, features, and documentation, is owned by ZMJ, Inc. and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service.

Your Content: You retain ownership of all content you create, upload, or generate using Ghost. By using the Service, you grant us a limited license to process your content solely to provide the Service to you.

Feedback: If you provide suggestions or feedback about the Service, we may use it without restriction or compensation to you.

6. Payments and Subscriptions

Some features of Ghost may require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees at the rates in effect when charges are incurred
  • Provide valid payment information and authorize recurring charges
  • Subscription renewals are automatic unless canceled before the renewal date
  • Refunds are available within 14 days of initial purchase if you haven’t used paid features

We may change pricing with 30 days notice. Continued use after price changes constitutes acceptance.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

  • The Service will be uninterrupted, error-free, or secure
  • AI-generated content will be accurate, complete, or appropriate
  • The Service will meet your specific requirements
  • Any defects will be corrected

You are responsible for reviewing and verifying any content or actions suggested by Ghost before relying on them.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZMJ, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless ZMJ, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or for any other reason with or without notice. Upon termination:

  • Your license to use the Service ends immediately
  • You remain responsible for any outstanding payments
  • Provisions that should survive termination (like liability limits) will continue to apply

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.
